1. Introduction
These terms ("Agreement") govern participation in the NOCFO Affiliate Program ("Program"). By joining the Program, the affiliate ("Affiliate") agrees to these terms.
2. Definitions
- Affiliate: A person or company approved to participate in the Program.
- Customer: A new user who registers and pays for an NOCFO service as a result of the Affiliate’s marketing efforts.
- Commission: The fee earned by the Affiliate for approved customer acquisitions.
- Payment Threshold: The minimum amount the Affiliate must earn before payment is processed.
3. Eligibility
The Program is open to individuals and businesses that operate legally and ethically. NOCFO reserves the right to approve or reject applications without justification.
4. Affiliate Responsibilities
- Promote NOCFO services using legal and ethical marketing practices.
- Avoid false or misleading claims.
- Comply with all applicable laws and regulations.
- Do not conduct search engine advertising on NOCFO brand keywords.
- Spam, unauthorized emails, and deceptive marketing practices are prohibited.
- The Affiliate is responsible for the legality of their marketing activities.
5. Commissions and Payments
- The Affiliate earns a commission for each new customer who subscribes to an NOCFO service.
- The commission rate and payment schedule are determined separately.
- Payments are made only if the customer has paid NOCFO and has not canceled their subscription within the specified period.
- Payments are processed 15 days after the end of the month in which the customer has made the payment or by the invoice due date.
- Payments are made via bank transfer or PayPal when the payment threshold is met.
- Different campaigns may have varying terms regarding duration, discounts, and other conditions.
- In case of payment disputes, the Affiliate must contact NOCFO within 30 days of payment processing.
6. Prohibited Activities
The Affiliate must not:
- Use fraudulent means to earn commissions.
- Provide false information or use the NOCFO brand without authorization.
- Market NOCFO on adult, gambling, or illegal websites.
- Attempt to circumvent the tracking system.
NOCFO reserves the right to cancel all accumulated commissions if the Affiliate violates these rules.
7. Termination of Agreement
- NOCFO reserves the right to terminate the Affiliate’s participation immediately if these terms are violated.
- NOCFO may also terminate the agreement with a 30-day notice without specific cause.
- The Affiliate may leave the program by providing written notice to NOCFO.
- If the agreement is terminated due to a violation, NOCFO has the right to withhold payments.
8. Liability and Indemnification
- NOCFO is not liable for indirect damages resulting from participation in the Program.
- The Affiliate agrees to indemnify NOCFO against any claims arising from their marketing activities.
- NOCFO does not guarantee any specific income level or earning potential for the Affiliate.
- NOCFO is not responsible for technical issues or tracking system failures that may affect commission accrual.
9. Amendments
- NOCFO reserves the right to amend these terms at any time.
- Changes will be communicated to the Affiliate via email or through the website.
- By continuing participation, the Affiliate accepts the changes.
- If the Affiliate does not accept the changes, they must terminate the agreement before the changes take effect.
10. Governing Law
These terms are governed by Finnish law. Any disputes shall be resolved through negotiations. If no agreement is reached, disputes will be handled in Finnish courts, primarily in the Espoo District Court.
